Divorce
usually means a step down in both parties' standard of living.
Married couples build their lives, as they should, with the
intention of staying together. When the marriage fails, financial
arrangements must be reviewed and reworked in light of the new
reality. The law anticipates this, and has built-in provisions to
help make this change gradually and reasonably.
I
will review your situation against the factors the court must consider when
ordering spousal support. I will help you get a temporary order until the
divorce is finalized, and defend against unreasonable demands. A fair support
agreement must be reasonable and sustainable, and take into account both your
history together and your new reality. Together we will get your new life off to
a good start.
The
purpose of Spousal Support is to give the supported party time to re-establish
his/her earning capacity and to regain his/her standard of living. It is always
negotiable. Even a final order is not carved in stone and is subject to
modification when there is a substantial change of circumstances. "For
better or for worse" goes the marriage vow. It remains the same after your
divorce. Until the court's jurisdiction for spousal support is terminated, I can
help you review your situation to determine if an update is in order.
